
Rental Policies
We’re committed to providing a smooth and enjoyable vacation experience. Please take a moment to review the following policies and agreements, which are in place to protect both guests and property owners.
🌦️ Weather / Acts of God
StayWise Rentals, the owner, and property management are not responsible for weather conditions, natural events, or acts of God during your stay. No refunds will be issued in such cases.
🏗️ Construction
We are not responsible for construction work or neighborhood noise. Refunds will not be made for any inconvenience caused.
⚠️ Unforeseen Conditions
If unexpected issues with the property arise before your stay, we reserve the right to issue a refund (per cancellation policy) or relocate you to a comparable villa with similar amenities.
🐾 Pets
Pets are not allowed unless you're staying in a designated pet-friendly villa.

Approved pets incur a $100 fee.

Unauthorized pets will result in termination of the rental, forfeiture of the deposit, and a mandatory cleaning fee. Immediate departure from the home will be required.
🧺 Cleaning & Linen Policy
Your home is stocked with:

Linens, towels, kitchen towels

A starter set of toilet paper and paper towels
Included in your stay:

Departure cleaning (excessive laundry or moved furniture may incur additional charges)

Guests must:

Bag and dispose of all trash

Start the dishwasher

Return moved furniture or decor to its original place

🔧 Damages / Condition / Personal Property

Report damage or issues within 24 hours of arrival or at your check-in appointment

Any damage during your stay will be charged

StayWise Rentals is not liable for lost or stolen personal property
⚠️ Assumption of Risk

Use of the property and pool is at your own risk

This home is not childproof
-
We are not liable for accidents, weather-related hazards, or equipment misuse
🏊 Pool

Do not adjust pool equipment unless instructed
-
Pool heaters take 2–3 days to warm and may be ineffective under 55°F
-
Water level must be 2–3 inches above the skimmer to prevent pump damage
-
Many homes feature pool alarms for safety
❄️ Air Conditioning

Do not set the A/C below 75°F unless explicitly instructed – it may freeze and break
-
If damage occurs, a $300 or higher repair fee applies
🚭 No Smoking

Smoking/vaping inside the home is strictly prohibited
-
If detected, deep-cleaning fees will apply and the agreement may be terminated
👥 Occupancy

Maximum occupancy is listed in each villa's description
-
Exceeding this number is a breach of contract
-
Extra guests not listed in the reservation may incur a $200 fee/person
🛻 Garage / Keys / Parking

Do not pull the red garage emergency release unless in an emergency

Lost garage remote: $100.00 charge

Lost key: $50.00 charge
-
Garage parking is not guaranteed unless specified
🔇 Noise Ordinance Policy (Cape Coral & Fort Myers)
To comply with city regulations and protect our neighborhood peace:

Quiet Hours: 10:00 PM – 7:00 AM

No loud music or outdoor gatherings during quiet hours
-
Parties/events are strictly prohibited
-
Violations may result in fines, contract termination, and deposit forfeiture

🛶 Use of Bicycles & Kayaks
By using equipment such as kayaks or bicycles, you:

Accept all risks and agree to use them responsibly

Agree not to hold StayWise Rentals, the owner, or property managers liable for injury, damage, or loss

Understand this waiver applies to all guests in your group
🔥 Use of Fire Features
Guests must use outdoor fire features responsibly:

You acknowledge you’ve been informed on proper use

Supervise children and those unfamiliar with usage

Use at your own risk
-
You release StayWise Rentals, the owner, and management of liability for misuse, accidents, or injury
🚤 Boat Lift Disclaimer

The boat lift is not automatically included; request use in advance

Use is at your own risk

StayWise Rentals and the owner are not liable for damage to the boat or lift

Guests assume all responsibility for safe operation
📃 Cancellation Policy

Cancel 14 days or less before arrival: 100% payment due

Contract changes after confirmation: $200 handling fee

We recommend travel insurance for cancellations or emergencies

⚖️ Governing Law
This agreement shall be governed by the laws of the State of Florida.
Disputes will be handled in Lee County, Florida.

Guests agree that StayWise Rentals, the property owner, and management are not liable for injuries, damage, or loss due to weather, accidents, negligence, or misuse of equipment or facilities. Guests assume full responsibility for themselves and their party.
✅ Guest Acknowledgement
By booking, the guest confirms they have read, understood, and accepted the rental policies listed above. All guests in the travel party are bound by this agreement.
